What is probate?

Probate is the legal process which allows someone to deal with the assets of a deceased. There are several types of grant of probate in Ireland.

Grant of Probate

Where a person dies and has both left behind a valid Will and has appointed an executor, the executor named in the Will will get a grant of probate for the estate from the Probate Office. The executor is obliged to deal with the estate in line with the deceased’s wishes set out in the Will.

Grant of Letters of Administration

Where a person dies without leaving a Will, the laws on intestacy shall apply to the estate. The estate will be dealt with by a person referred to as an administrator. Under Irish law, the person or people who may become an administrator of an estate are generally the relatives closest to the deceased.

Grant of Letters of Administration with Will Annexed

A Grant of Letters of Administration with Will Annexed will be issued where a person dies with a valid Will in place, but a person other than the named executor is applying for the grant of probate. This generally applies to circumstances where an executor is unable or unwilling to act, or no executor has been appointed.
