Cyclists have the same rights as any other road user but are the most vulnerable.  In road traffic accidents, an injured cyclist must prove on the balance of probabilities that the other party caused the accident which resulted in his injuries.

If an injury is sustained in the accident, the Gardai should be involved called.  In minor accidents with no injuries, the Gardai may not be involved.   If there is damage to the bicycle and a dispute as to liability, the Gardai should be called.

In road accidents which results in injury, cyclists should seek medical examination.  It might be the case where a person feels the injuries are minor or will heal over time, but later more complex medical issues arise which can be related back to the injury caused in the road accident.  So, visit your local GP and get examined whether you think the injury is minor or not.

While at the scene of the accident, and assuming the injuies sustained are not serious, take the car registration number, insurance details of the other driver and as most people have mobile phones, take pictures of the road, insurance disc, road signs (if any), location and vehicles.  If you are able, get the name and phone numbers of any witnesses.

The more information available about the crash scene the better it will assist the court in making a decision.
